Athlete agreement

As part of the participant agreement between the organizing committee of the Black Forest ULTRA Bike Marathon and the participant.

1. Eligibility for participation
Male and female athletes may take part in the Black Forest ULTRA Bike Marathon, no matter if they are members of a union, a society or hobby athletes. The participants confirm that they only enrole for the track which is approved for their age according to the regulations. Not properly registered bikers may not participate in the race.

2. Risks and Hazards
Athletes are aware that mountain biking involves risks, such as fatigue during the competition. During the marathon, athletes push their physical limits significantly. It is acknowledged that such a competition can jeopardize life and safety due to environmental conditions, equipment, weather, road traffic, and obstacles. Traffic regulations apply on public roads.
The organizer can only take security measures for foreseeable risks. It is understood that not everything is foreseeable or controllable. The organizer is not obliged to take excessive measures that are not proportionate to the potential harm.
By starting, the participant agrees to the condition and nature of the race track and knowingly assumes all risks, even if they arise from underestimating the difficulty of the course.
The participant is responsible for their equipment and the choice of their racing line.

3. Rights and Duties of Riders
The assigned race number must be securely attached to the handlebars and must not be altered or damaged.

It is mandatory to wear an approved bicycle helmet and gloves throughout the entire race.

Athletes who exceed the time limit or abandon the race must surrender the designated portion of the race number at a course post.
Every rider must carry a valid ID card.
Extra caution is required in sections of the route where visibility is limited. In case of breakdowns and repairs, participants are required to remain off the race track.

4. Personal Liability
The athlete is personally liable for any damages to third parties resulting from their participation in the competition, whether it be bodily injury or property damage. In the event of an accident, the responsible party must provide their race number and personal information to the affected individual or the nearest course post. Liability insurance at one's own expense is recommended.
The participant is solely responsible for their equipment. The organizer is not obligated to inspect or monitor the participants' equipment.
The liability of the organizer for ordinary negligence is limited to the extent and amount of the organizer's liability insurance.

5. Cancellation of athlete's participation
It is recommended to conclude the Datasport-insurance available in the online registration process. (Information on this can be found here). The insurance will only reimburs the amount against a document from a doctor, proving that an illness or accident was hindering the athlete at participating in the race. In case such an insurance had not been concluded the starting fee cannot be reimbured in case of cancellation of participation. However it will be possible to delegate the participation to another person against a fee ob 10 €. Informatino on delegating a participation

6. Event Cancellation
The organizer reserves the right to adjust the regulations, route, and altitude profile. The event will take place in all weather conditions as long as the safety of the athletes is not compromised. However, the organizers reserve the right to interrupt the event, delay the starts, or cancel the race at short notice at their discretion.
If the event cannot take place due to force majeure, all relevant details will be announced on the event website or on-site during the race.

7. Support During the Race
Supporting athletes during the race with private vehicles on the course is strictly prohibited.

For medical assistance, emergency physicians, trained first aiders, and mountain rescue services are available.

8. Doping
The participant is aware that doping involves the deliberate manipulation of the body to achieve better performance and that this is punishable according to the statutes of the UCI, the German Sports Association, and the German Cycling Federation. Unannounced controls may be conducted at any time.

9. Disciplinary Rules and Disputes
The statutes of the German Cycling Federation and its disciplinary regulations are acknowledged. It is hereby agreed that these regulations are part of the participant contract.

Organizers and participants agree that, in the event of disputes, settlement of the dispute through the jurisdiction of the association's courts or the association's arbitration process shall be sought before resorting to regular courts. This agreement also applies to the participant's successor in rights.
